These conditions of sale are applicable to all contracts concluded between, on the one hand, BYSIX whose operating head office is located in Mouscron Belgium, registered with the Banque Carrefour des Entreprises under number 0713.773.609 below. hereinafter referred to as "the seller" and, on the other hand, any person wishing to make a purchase via the seller's website, hereinafter referred to as "the buyer".

We mean by:
Buyer: any natural person who has reached the age of majority and has full legal capacity or, failing that, the legal representative of this person. In the latter case, the legal representative is required to comply with these general conditions.
Consumer: any natural person who acquires or uses for purposes excluding any professional or commercial nature of the products placed on the market.
Professional buyer: any natural or legal person not falling within the definition of consumer given in the previous paragraph.
1. Object
These conditions of sale aim to define the contractual relations between the seller and the buyer as well as the conditions applicable to any purchase made through the seller's website.
By accepting the order confirmation via our website, the buyer expressly acknowledges having read these general conditions, having understood them and having accepted them, it being understood that any order for a product via our website assumes the consultation and express acceptance of the general conditions of sale. These general conditions of sale can be saved or printed by the customer.
The provisions from which are not expressly deviated from remain in application. Only exemptions subject to written agreement on our part may modify the application of these general conditions. The seller nevertheless reserves the right to modify its general conditions at any time. The conditions applicable to the order are those in force at the time of confirmation.
In the event of any conflict between the general conditions of our co-contractors and ours, it is agreed that only the latter will prevail.
2. Products
Unless otherwise stipulated in writing, the products that we offer on our website are those which appear there on the day of the order, within the limits of available stocks.
3. Orders
Any order entrusted to us is binding on us only after written confirmation from us by e-mail. Samples and other free offers announced before ordering are limited to available stocks. In the event of out of stock for the products offered, BYSIX will not be held responsible.The tailor-made confections are produced according to of the order form on the BYSIX website, additional requests may be subject to price modifications. The seller reserves the right to partially process additional requests and cannot be held responsible for non-compliance with them, to the extent that they are not part of the initial manufacturing form. Modifications made by the customer to his order form or to our offer will only be valid on the condition that we have accepted and confirmed them in writing.
In the event of unilateral cancellation of an order by the customer acting for professional purposes, we reserve the right to demand compensation equal to 50% of the total amount of the order.
3.1 Color chart
The buyer has the option of renting or purchasing our complete color chart, in order to determine the shade that suits them.
In the case of rental: The color chart is charged €11 excluding delivery costs. However, a deposit of €60 will be paid. The consumer has 72 hours upon receipt of the product to return it via the competent postal services, always with insurance included. The deposit of €60 will be refunded upon receipt of the product by the seller. The refund will be made to the buyer's payment method used when ordering. In the event of a late return, BYSIX reserves the right to refuse any refund or, at its sole discretion, to issue a partial refund limited to 50% of the rental fee. BYSIX shall not be required to provide any justification for applying this measure.
In the case of purchase: The color chart is invoiced at €71 excluding delivery costs.
4. Order confirmation
After validation of the order and once payment has been made, the consumer receives an order confirmation by email as well as a summary, listing all the validated products. Our service will then take care of creating the hair within 48 hours, if it is requested to measure or in stock. Example: In order to validly place their order, the buyer must:
- Complete the identification form or give your customer number if you have one.
- Complete the online order form giving all the references of the products or services chosen.
- Validate your order after checking it.
- Acknowledge having read these general conditions and having accepted them.
- Make payment under the agreed conditions.
- Confirm your order and payment.
The sale is deemed complete upon confirmation of the order by the buyer. No shipment of merchandise will be made without order confirmation and receipt of full payment thereof.
Products and services are offered while stocks last. If an item is unavailable, the seller will inform the buyer by email as soon as possible. The customer will have the possibility to choose between waiting (in the event of temporary unavailability) or canceling the order of unavailable items free of charge.
5. Deadlines
The deadlines set for our tailor-made services are between 10 and 14 weeks with the standard option and between 4 and 6 weeks with the Express option. For hair systems "in stock" the shipping time announced by our services is 12 working days, plus the delivery time depending on the postal services. Shipping of pre-orders (Waiting List) is estimated between 15 and 40 days depending on production.
All of our hair systems are handmade by our technicians, so we ask our users to be tolerant of delays. Deadlines may be delayed by a few days/weeks without compulsory compensation.
For the manufacture of a hair system according to a size template, manufacturing begins once the mold is received and sent to our technicians. It is therefore generally necessary to allow an additional week to the announced deadlines. All tailor-made products are validated after 48 hours to allow possible modifications before manufacturing.
In the case of specific options (longer hair length, density greater than 110%, base size greater than 20 x 25 cm, personalized color, etc.), a delay may be observed of several days/ weeks.
For an order of products without hair system, shipping is done within 24 to 48 working hours. If your order includes a prosthesis (stock or custom-made) as well as products, the delivery times will be those of the hair supplement (the longest). Only one delivery per order. NB: Delivery times must be differentiated from shipping times.
For payment by bank transfer, the creation of the custom hair (or the sending of a hair supplement from stock) will only begin once the amount has been received by our establishment.
Even in this case, the following circumstances release us from our deadlines:
Cases of force majeure (in particular, strikes, technical incidents, flood, fire, shortage of the product from our supplier, national or global pandemic, computer virus, etc.);
If the order for the start of our services is given late in relation to the contract upon our order confirmation;
If the payment conditions are not respected;
If the customer does not provide us with the information necessary to process his order.
If the customer places his order during the holiday period of our technicians.
5.1 Legal vacation periods
From February 1 to 10, from October 1 to 7, from January 24 to 31.
6. Deliveries and transport
The delivery of the Product(s) ordered takes place at the address indicated by the buyer when placing the order. BYSIX cannot be held responsible in the event of non-delivery or delay attributable to postal services, the carrier, or an incorrectly entered address by the customer. In the case of a sale to a professional, transportation is carried out at the buyer’s own risk.
The buyer must check the general condition of the package as well as the contents of the order upon delivery, and this in the presence of the delivery person. In the event of a missing, damaged, or non-conforming item, the customer is invited to refuse the delivery or to record precise and dated reservations on the delivery slip, then to contact BYSIX customer service within a reasonable time at: contact@bysix.eu. In the absence of any reservation made upon receipt, any subsequent claim relating to a visible shortage at delivery may be subject to verification based on BYSIX’s quality control and traceability records. Each order is subject to photographic and video control prior to shipment, with precise weighing before and during transport, certifying the conformity of the products shipped. These elements may be produced in the event of a dispute as proof of conformity.
If the package arrives damaged due to transport, BYSIX cannot be held responsible and will not be required to issue a refund. However, a claim may be filed with the carrier under its own insurance conditions.
If the tracking status indicates “Delivered” but the buyer declares that the order was not received, an investigation will be opened with the carrier. The buyer must complete a non-receipt declaration and, for certain orders, file an official complaint in order to enable processing by the transport insurance. In this case, a new shipment may be made upon receipt of the requested documents. No refund will be granted until the investigation confirms the actual loss of the package.
For buyers residing outside the European Union, customs duties, local taxes, brokerage fees, or administrative fees may be levied by the authorities or the carrier upon importation. These fees are the sole responsibility of the buyer.
In the event of refusal of delivery, non-payment of taxes, failure to provide required documents, or failure to respond to customs authorities or the carrier, the package may be returned to the sender. In this case, the refund will be issued after deduction of all costs actually incurred by BYSIX, including, in particular, the initial shipping costs, return shipping costs, as well as any customs, brokerage, storage, or administrative fees charged to the order.
For custom-made orders, the buyer may request the return of their hair sample or mold at the time of shipment. In the event of a separate shipment request, transportation costs will be charged to the buyer.
7. Right of withdrawal
To initiate an online return, please contact our customer service team by email.
In accordance with applicable law, the consumer has the right to notify the seller of their decision to withdraw from the purchase, without penalty and without stating a reason, within 14 calendar days from the day following delivery of the goods. This right of withdrawal does not apply to professional buyers.
Made-to-order products are non-exchangeable and non-refundable. This also applies to the Smart HD when a wave personalization has been implemented.
Care products (Purity, Intensity and any other cosmetic product) as well as accessories (combs, brushes, clips and similar items) are excluded from the right of withdrawal once delivered to the consumer, as these products are unsealed and cannot be returned for hygiene reasons, in accordance with Article 16(e) of Directive 2011/83/EU, Article L221-28 of the French Consumer Code and Article VI.53 of the Belgian Code of Economic Law.
Within this period, the consumer must notify their decision to withdraw by means of an unambiguous statement, either by email to contact@bysix.eu or by post to our registered office address as stated above.
In the event of withdrawal, the seller will refund all payments received from the buyer, including delivery costs, without undue delay. However, refunded delivery costs are limited to the standard delivery rate. If the consumer has expressly chosen a faster delivery method (Express), the corresponding additional costs will not be refunded, in accordance with Article L221-24 of the French Consumer Code and Article VI.51 of the Belgian Code of Economic Law.
In the event of an exchange, the seller accepts product returns only. Should the buyer wish to benefit from multiple exchanges, the seller reserves the right to refuse the return of the item and to proceed with order cancellation.
Return shipping costs are the responsibility of the buyer, and goods travel at the buyer's own risk.
The item must be returned in its original packaging, accompanied by all accessories, samples and complimentary products, the user manual, and must not have been subject to any damage (wave modification, moistening, coloring, or any other handling that would prevent the item from being restocked).
The seller reserves the right to issue only a partial refund if the returned item is found to be damaged, incomplete or deteriorated.
PLEASE NOTE: the lifespan figures mentioned on the website are indicative and depend on each individual user and their daily routine. As this type of product is considered perishable, BYSIX shall not be held liable should the customer experience a lifespan shorter than that communicated on the website.
If the customer is not satisfied with an application carried out by themselves or by a professional, they may not under any circumstances call into question the quality of the product purchased in our store, nor request a refund.

8. Price
The prices set are expressed in euros, all taxes included (TTC).
Our prices are in principle not revisable, but we may however make a price change or pass on changes to the VAT rate occurring before the delivery date.
BYSIX also reserves the right, at any time, to modify its prices. However, the prices applicable to the order are those in force at the time of the handover of this one.
8.1 Professional benefits
BYSIX offers different offers intended for professionals, partners or resellers. Access to these offers is exclusively reserved for professionals who own a business. Individual customers do not have the possibility of accessing it.
BYSIX reserves the right, at any time, to refuse or withdraw access to pricing and other offers advantages for certain professional customers, without justification.
All information communicated by BYSIX for professional customers with access to specific offers is strictly confidential.
9. Payment
We make the following payment methods available to the customer:
Bank card (VISA, MasterCard, American Express), Bancontact, PayPal, bank transfer. Each order paid by bank transfer will only be taken into account upon receipt of the total amount of the order. The transfer must be made to the account indicated during order validation. Any costs related to the payment of the amount will be the responsibility of the customer and must not be deducted from the initial amount corresponding to the order.
The secure bank card payment server may detect an anomaly. The BYSIX team may ask you for personal identity and address information by email and/or telephone in order to prove your identity to lift the block. This procedure is valid for card payments via the secure server. In the event of no response, the order will be canceled and the amount refunded to the original payment method.

Payment in installments/deferred is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
Amount of purchases:
P2X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
P3X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
P4X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
By paying in several installments with Alma, the Customer does not pay any fees. Except for the following cases:

P4X: No fees
Alma is an electronic payment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the Civil Code.
Termination:
Any termination of the T&Cs which bind the Seller and the customer, results in the termination of the T&Cs between Alma and the customer.
9.1 Payment by subscription
Certain items in the online store are available for purchase monthly or every 3 months. This functionality allows you to place an order and obtain automatic billing by subscription in order to avoid manually renewing the purchase. When validating your subscription purchase, you agree to be billed automatically on the scheduled date including the shipping and handling costs mentioned when validating your first order. If during the automatic renewal of your order, the item is not in stock, invoicing will still be carried out and our service will contact you to inform you and will offer you either to wait for the restocking, or the cancellation and the refund. At any time, our users have the possibility to cancel their subscription(s) from their customer account, or to update their payment method.
If a direct debit is not honored, the order will not be completed, or it will be canceled. BYSIX reserves the right to manually cancel the order in the event of an error in the amount invoiced or suspicion of fraud. The withdrawal or return periods remain unchanged and all the terms of these general conditions remain valid for subscription payments.
Professional customers are eligible for subscription products but will not be able to make untimely cancellations. BYSIX reserves the right to permanently terminate subscriptions in the event of excessive purchase/cancellation usage to benefit from additional discounts. Customer accounts may also be suspended or terminated.
9.2 Loyalty program, promotional codes and discounts
Promotional codes are valid on the items listed in the promotion, excluding color chart rentals, service purchases, VIP/PRO benefits, and subscription items. Promotional codes are subject to availability and are not guaranteed.
Promotional codes cannot be exchanged for cash or any other benefit, such as gift certificates. A promotional code cannot be combined with another promotional code. A promotional code can only be applied to a new, eligible order and cannot be applied to a purchase already made.
If you cancel or choose not to use your order, you are not entitled to a refund of the discount value, nor can the promotional code be reactivated.
Promotional codes offered for leaving a review in the store are valid for sixty days from the date of activation and cannot be combined with other codes. These codes are automatically generated by software and cannot be modified. These codes are used directly by the buyer via an online order and cannot be used for order creation by customer service.
BYSIX reserves the right to modify or cancel the promotional code at any time, as well as to cancel a promotion and/or refuse the application of a promotional code if the total value of the promotional code already applied exceeds a certain financial value or a limited quantity. BYSIX also reserves the right to refuse the application of a promotional code if the final order amount results in a financial loss.
The "BYSIX & You" loyalty program automatically awards points that can be converted into euros for single purchases. These points can be used for purchases of €50 or more within 6 months. The program is not available to professional partners, customers with a financial advantage (partner, pro, wholesale), or for subscription purchases. In the case of a request for a professional account, access to the loyalty program is terminated without the possibility of returning the points to the customer.
The referral program linked to "BYSIX & You" is available to all customers who have joined the loyalty program. The referral link is available in your account under the Earn > Invite Friends section. The referred friend must not be an existing customer of the store. Only new customers are eligible to benefit from this referral offer. The referrer must not use their own referral link to place orders. This includes any attempt at self-referral. In case of abuse of the referral program, the seller reserves the right to remove the buyer from the loyalty and referral program and to cancel any referred orders. Abusive behavior includes, but is not limited to, creating fake accounts or using multiple links for unfair personal gain.
Birthday points are final and can only be awarded once per year per customer. If your date of birth changes, no points will be awarded for the new date.
The loyalty program is not retroactive to May 31, 2023. Orders placed before this date are not eligible for this program.
VIP benefits are an extension of the "BYSIX & You" loyalty program, which is scheduled to launch on February 9, 2026, and is not retroactive. Access to VIP levels is contingent upon accumulating a minimum number of points, according to the terms and conditions in effect at the time of access.
When a purchase grants direct access to a higher VIP level, only that level is awarded, without the benefits of lower levels being combined.
The VIP level point accrual rule replaces the basic rule, therefore there is no accumulation of points.. Level rewards are awarded only upon reaching the relevant level and are not renewed with each order. Some benefits may have a limited validity period and expire automatically at the end of that period. Each VIP level is valid for a maximum of twelve (12) months. Maintaining the level is contingent upon the buyer's activity during the elapsed period, according to criteria defined by BYSIX. VIP benefits are neither exchangeable, nor convertible to cash, nor can they be combined with specific professional, partner, or pricing benefits. In the event of abuse or fraud, BYSIX reserves the right to suspend or terminate access to the VIP program and its associated benefits.
BYSIX reserves the right to modify, suspend, or terminate the VIP program at any time.
10. Warranty in the event of sale - Buyer acting for non-professional purposes
The buyer acting for private purposes benefits from legal rights under the law of September 1, 2004 relating to consumer protection in the event of the sale of consumer goods.
In accordance with article 1649quater §2 of the Civil Code, the consumer is required to inform the seller of the existence of a lack of conformity from the day the consumer received his order.
This guarantee only covers conformity defects existing at the time of delivery of the goods. Defects or damage due to misuse, such as water damage, oxidation, tear, fall or shock, neglect and wear, are not covered by the warranty. Likewise, repairs carried out by technicians not approved by our services will result in the cancellation of the warranty. The invoice or delivery note serves as a guarantee document and must be kept by the consumer and produced in original.
The Buyer acknowledges that due to the artisanal nature of the manufacturing process, each custom-made product is unique. Although the design parameters may be identical, natural variations may occur from one product to another, particularly due to the use of natural human hair. These differences are an inherent part of the manufacturing process and shall in no way be considered defects.
Before any installation or modification, it is the Buyer’s responsibility to check the conformity of the product received. The Seller shall not be held liable for reimbursing or compensating any costs incurred with third parties, such as installation, cutting, maintenance, or any other services performed on the Product. In the event of a claim or the implementation of the legal warranty, only the obligations relating to the Product itself shall apply.
The Buyer also understands that a custom-made product may require certain adjustments after delivery to achieve a perfect fit. Such adjustments fall under the responsibility of the professional performing the installation and do not constitute valid grounds for a claim or for questioning the product’s conformity.
To enable the implementation of the legal warranty, the Buyer may be required to return the product in question so that a quality control and expert assessment can be carried out. Following this inspection, the Seller will decide, at its sole discretion, whether to repair or replace the product.
It is the Buyer’s responsibility to have a backup hair system or an alternative solution available, enabling them to return their hairpiece if an issue arises, without holding the Seller liable for the period during which the product is under assessment.
11. Privacy protection, data processing
The personal data communicated by the customer are strictly confidential. We undertake to use them only as part of the processing and proper execution of the customer's order and to only authorize access to this information to members of staff who must be aware of it for the proper management of the customer's order. commands.

12. After-sales service
The customer can request the exchange of their “in stock” product within 7 days from the date of receipt, in the event of an error in the choice of the shade or the product itself. It will be necessary to contact us beforehand by e-mail contact@bysix.eu in order to proceed with the exchange if we consider that the customer is eligible.
Return costs are the responsibility of the customer and the latter cannot under any circumstances request reimbursement.
Only one exchange per order is possible. Return costs are the responsibility of the buyer and the goods travel at their own risk. The item must be returned in its original packaging, accompanied by all its accessories, the user manual and must not have been subject to any damage (change in undulation, humidity, coloring, or any other manipulation preventing the good from being put back into stock).
If the customer is not satisfied with the installation carried out by himself or the professional, he cannot under any circumstances call into question the quality of the product purchased in our store and cannot request a refund for his product.
Custom-made products are not exchangeable.
PLEASE NOTE: the lifespans mentioned on the site are indicative and depend on each user and their daily life. This type of product being considered "perishable", the company BYSIX will not be able to compensate the customer if he notices a lifespan shorter than that communicated on the site.
IMPORTANT: When returning your hair prosthesis for after-sales service, it is important that the hair is perfectly clean and cleaned, without residue of hair glue or other product. Without this, our after-sales service will not be able to accept the expertise.
13. Responsibilities
The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network and online payment such as loss of data, intrusion, viruses, interruption of service, or other involuntary problems.
The data included on the site is communicated in good faith. The links provided to the sites of manufacturers and/or partners are given for information purposes and have no contractual value. The seller cannot be held responsible for information from these sites.
The buyer is responsible for the choice and use of the product delivered by the seller. He certifies being over 18 years old at the time of ordering. The seller declines all responsibility in the event of inaccuracy of the information communicated to him by the buyer.
IMPORTANT: It is recommended for all people to carry out an allergy test before applying fixing, maintenance or care products. In the event of a reaction or problems related to the use of the products, BYSIX cannot be held responsible.
14. Intellectual property
All elements of the seller's site are and remain the intellectual and exclusive property of the seller.
No one is authorized to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple or hypertext link is strictly prohibited without prior written agreement with the seller.
15. Evidence
The parties accept, within the framework of their relations, electronic means of proof (for example: e-mail, computer back-ups, etc.). In the event of complaints following the purchase of one or more items on this site, it may be necessary to return the goods so that the after-sales service can carry out checks.
16. Disputes
These conditions of online sale are subject to Belgian law.
In the event of a dispute, the courts of the seller's head office have jurisdiction, unless otherwise binding legal provisions. Information on alternative dispute resolution methods can be obtained via the link https://ec.europa.eu/odr/
We nevertheless reserve the right to submit any possible dispute exclusively to the courts.
17. Changes to the convention
Any change to the specific agreements or general conditions present must be the subject of a written amendment signed by all parties. Validation of the general conditions in the shopping cart is valid.
18. Saving clause
The invalidity, non-applicability or illegality of one of the clauses provided for in one of the contracts agreed between parties (specific and general conditions or other agreements), does not in any way result in invalidity or nullity other provisions of the contract. All clauses remain fully valid.
